sales conditions

1. payment terms :


These TCS apply, without restriction or reservation, to all sales made by EUROPA GRAND CRU to CUSTOMERS wishing to purchase the products offered for sale on its Internet site www.grandcru.com.

These TCS are accessible at all times on this Internet site and, if occasion arises, shall prevail over any other version or any other contradictory document.

The act of confirming his order to EUROPA GRAND CRU constitutes full and complete acceptance by the CUSTOMER of these TCS in their entirety.

The products offered are subject to stock availability.

Information regarding product availability is provided by contacting EUROPA GRAND CRU by mail, by phone, by fax (see below the Orders section).


2. orders


The CUSTOMER selects the products on the site that he/she wishes to order by contacting directly EUROPA GRAND CRU.

The sale will be considered final only after the payment of the invoice has been received in full.

The CUSTOMER can consult the order at any time by contacting EUROPA GRAND CRU from
Monday to Thursday : 9:00 a.m. - 6:00 p.m.
Friday : 9:00 a.m. - 5:00 p.m. (GMT +1:00)

3. prices


Products are supplied and delivered at the prices in effect on the date of confirmation of order acceptance by EUROPA GRAND CRU and as communicated to the CUSTOMER before the order is placed.

The price indicated in the order confirmation by EUROPA GRAND CRU is the final price.

Prices of deliverable wines are given in Euro before tax and all taxes included (except for en primeur wines for which prices are given excluding tax only), and they include excise tax.

They do not include shipping costs, which will be billed at the current rate at the time of delivery and which will vary according to country and shipping option (see summary table of costs).

Upon reception of the order, an invoice will be sent to the customers.
A payment confirmation is prepared by EUROPA GRAND CRU and sent to the CUSTOMER by e-mail once the amount of the order is paid.
The proof of payment will guarantee the rightful ownership of the wines.


4. offer validity


Products are offered for sale as deliverable wines and en primeur wines until stocks are exhausted.
In the case of primeur wines, wineries and owners are solely responsible for the production of their wines, choice of bottling date, and the decision to make wines available.

payment terms
The price is payable by using one of the payment methods outlined below and in full on the day the order is placed by the CUSTOMER (except for approved trade accounts), according to the terms and conditions specified in the section on Orders.
EUROPA GRAND CRU will not be required to deliver products ordered by the CUSTOMER if the price has not been paid in full in advance (price including all taxes and delivery including all taxes).

Payment methods
Whatever payment method is chosen by the CUSTOMER, the order will not be considered paid for until the amounts owed to EUROPA GRAND CRU have actually been collected. Payments are made in Euros by bank transfer (see details in Payment section).

Ownership retention clause
Should the CUSTOMER fail to pay all or part of the order price, EUROPA GRAND CRU reserves the
right, until payment is made in full, to retain ownership of the products sold, which enables EUROPA GRAND CRU to regain possession of said products.

order fulfillment
The order is filed when EUROPA GRAND CRU has collected payment and received all information necessary to execute the contract (CUSTOMER's or recipient's complete information).
The order will not be filled until EUROPA GRAND CRU has received all required information.
Should this occur, EUROPA GRAND CRU may not be accused of a delay in delivery.

Delivery
If all or part of the delivery address is incorrect, obliging EUROPA GRAND CRU to return the orders to its
warehouse,the CUSTOMER bears all consequences (delayed delivery, any repercussions on shipping cost…).


• En primeur wines


The sale of en primeur wines is subject to these TCS, taking into account the following special requirements.

Payment
Upon ordering : an initial down payment corresponding to the total price in Euros before taxes is to be paid when the order form is submitted on the site. Upon receipt of the final invoice when the en primeur wines are ready for delivery: the balance of the order (delivery cost and VAT at the rate in effect on the day of delivery of the products, in Euros).
The delivery charges and the VAT rate in effect on the date of delivery may change between the date when the products are reserved and the date of their actual delivery.
Should the final price for the order be too high in relation to the price stipulated upon conclusion of the contract, the CUSTOMER may break the contract.

Coordinates
CUSTOMERS are required to inform EUROPA GRAND CRU of any change in their contact details.

Delivery
Wines will be delivered in the first half of the third calendar year following the date of harvest unless otherwise decided by the winery.
The CUSTOMER will be informed of the availability of the wines ordered by e-mail or by fax or by courier.
This will allow the CUSTOMER to consult and pay the remaining balance (shipping costs and VAT) in order to receive the wines.
On this occasion customers will confirm or change their delivery address.

Cancellation
In line with the provisions of articles L. 121-16, L. 121-19 and L. 121-20 of the Consumer Code, the CUSTOMER is entitled to cancel the order.

Upon receiving the down-payment invoice (sent to the CUSTOMER in the weeks following the placing of the order), the CUSTOMER has fifteen days to return the down-payment invoice and a written request for reimbursement dated and signed by the CUSTOMER.


6. Deliveries


EUROPA GRAND CRU delivers to several European countries (see table of costs: Services – Delivery).
The products purchased by the CUSTOMER are delivered within an average of ten (10) to fifteen (15) business days after the order is placed, unless the data corresponding to the product(s) selected bythe CUSTOMER indicate a longer time or in the case of en primeur sales or delivery abroad.

If the CUSTOMER orders several products having different delivery times, the applicable time is the longest delivery time.
The products ordered will be delivered to the address indicated by the CUSTOMER when placing the order.

Except in special cases or if one or more products are unavailable, the products ordered will be delivered in one shipment.
Deliveries are made by an independent carrier.
Delivery is considered to have been made when the products are handed over by the carrier to the CUSTOMER, as proven by the CUSTOMER's signature on the delivery slip.
Only the CUSTOMER's signature proves a conform delivery.

Three months after the expected date of delivery, will assume that the delivery has been made, unless we receive a call or an e-mail from a customer informing us that they have not received their order.
After this period of three months, customers can no longer report undelivered orders.

The CUSTOMER is required to check the condition and conformity of the products delivered at the time of delivery.
The CUSTOMER may then either accept the order, if it appears as ordered, noting any reservations on the delivery slip, or refuse the order if the order is clearly not as ordered (stained or broken bottles, for example)...
If the products delivered are not as ordered, EUROPA GRAND CRU will bear the costs of returning and replacing the product as quickly as possible.
If the product cannot be replaced, the CUSTOMER may return the product and receive a refund, or keep the product and be reimbursed part of the price.


7. Transfer of ownership - Transfer of risk


Products travel at the risk and peril of EUROPA GRAND CRU.
Transfer of the risks of loss and deterioration of the products will occur when the CUSTOMER signs the delivery slip.
Transfer of ownership of the EUROPA GRAND CRU products to the CUSTOMER will occur only after the latter pays the price in full, regardless of the date of delivery of the products.


8. Right of withdrawal (right of return)


According to law and without having to provide reasons or to pay penalties, the CUSTOMER has a withdrawal period of seven days from delivery of the products to return them to EUROPA GRAND CRU at the address of its registered office for exchange or reimbursement, on the condition that the products are returned in their original packaging and in perfect condition within eight days from delivery.

The amounts paid by the CUSTOMER, including delivery costs, will be fully reimbursed by banktransfer to the account indicated for that purpose by the CUSTOMER or by cashier's cheque within a maximum of from one to three months following the exercise of the right of withdrawal.
The expenses incurred by EUROPA GRAND CRU for the return may however be charged to the CUSTOMER.


9. Protection of people under 18 years old.


In accordance with article L. 3342-1 of the Public Health Code applicable to sites selling alcoholic beverages on the Internet, which states that the sale of alcohol to minors under the age of eighteen (18) is prohibited.


10. Disputes


The CUSTOMER and EUROPA GRAND CRU will do everything possible to resolve amicably any disputes that may arise from application of these TCS by calling EUROPA GRAND CRU's CUSTOMER Service (cf. point relating to Orders) which is authorized to take all measures necessary for resolving disputes.

In the event of problems occurring in applying these TCS, we invite you to seek an amicable solution by contacting our Customer Service.

Subsequently, in the case of the orders from CUSTOMERS who ordered from within France, all disputes to which the present contract may give rise concerning its validity, interpretation, execution, termination and their consequences and aftermath will be subject to French law and to the Courts of the place of EUROPA GRAND CRU's registered office.

In the case of the orders from CUSTOMERS who ordered from outside France, any dispute arising as part of the execution or interpretation of these TCS will be brought before the competent courts by virtue of the directives and regulations of the European Union.


11. Contract language and applicable law


By express agreement between EUROPA GRAND CRU and the CUSTOMER, these TCS are governed by and subject to the application of French law.
For the sake of convenience, these TCS have been translated into English. In the event of a dispute, only the French text is authoritative.


12. CUSTOMER's acceptance


For a natural or legal person, the act of ordering on the EUROPA GRAND CRU Internet site carries with it full and completes acceptance and approval of these TCS, which is expressly acknowledged by the CUSTOMER,who in particular waives the right to invoke any contradictory document, which would be void and of no effect against EUROPA GRAND CRU.

The headings of each article are solely for ease of reading and may in no case be grounds for any interpretation or distortion of the clauses to which they refer.
